Media Coverage and the Right to a Fair Trial

In her written statement last November 9 2005, Barbara E. Bergman, the President of the National Association of Criminal Defense Lawyers, aptly stated in behalf of the NACDL that the fundamental issue of every criminal trial is not to entertain, nor to educate, but to administer justice[1].The controversy regarding whether media coverage of criminal trials is detrimental to a fair trial or not is hotly debated and difficult to balance. Even high caliber lawyers have not reached a general consensus about the issue. The tension between the pros and cons of the said subject is still being balanced every time process of litigation is on going. Questions arising from this issue involved: How much of the media be allowed? Will it be helpful to let the media cover every trial of a particular case from start to finish?What about the parties involved? Does decision to permit the media or not be the sole right of the judge, or is it the right of all the parties involved, including the defendan t? These are but â€Å"some† of the important components that embody the whole subject. The apprehension is that, too much publicity might affect the trial’s fairness. The unrestrained freedom given might be used or manipulated to influence fair and just decisions on the parts of the jury and the judge.This paper covers the different views pertaining to media coverage/publicity of a trial. What are the advantages and disadvantages when media coverage is allowed? What are the effects – negative or positive – of the media to a fair trial?The Pros of PublicityArguments for media coverage inside the courtroom are solid and convincing. The public whose curiosity have made them a part of the trial must be given the chance to participate, or else, mistrust to jurisprudence will take place among people in general, as a result. Media coverage is of great assistance in this area.It prevents closed door proceedings and subjects people of authority to the scrutiny of the public and thus avoid further corruptions which could otherwise happen when media is banned from the deliberations. Insights to the already wisely crafted laws are contemplated and possible or potential modification of existing laws is considered. As Barbara E. Bergman has stated in her testimony, â€Å"Court TV must be credited for its considerable contributions in all of these areas†[4].The Cons of Media CoverageThe arguments against media involvement in judicial processes are equally convincing. There are also disadvantages to unrestrained media meddling. One primary concern is its negative effects to the parties involved in a particular litigation. The conspicuous presence of cameras inside the courtroom will affect the behaviors of the â€Å"main players† of a specific case.It will thus weaken the procedure or the â€Å"fair administration of justice†[5]. Because lawyers, defendants, jurors, and judges, and witnesses are aware that they are being watched, in this kind of scenario, their tendency is to act unnaturally; in other words, they may act hypocritically, and this will be to the detriment of fair judicial process. In the O.J. Simpson case, there were instances when crucial witnesses withheld their testimonies because of fear that they are being watched by the public[6].If the jurors had been made aware beforehand that the case they were handling would be televised and publicized, the overall verdict would definitely be affected. Concern for the public’s opinion of whatever the eventual decisions they will ever come up regarding the future of the defendant, will or may get into the deliberations process.ConclusionThe important thing in the whole scenario of judicial procedures everywhere is striking a balance between the pros and the cons of media involvement. First, of course is the fairness that begins in whose authority it is to say â€Å"yes† or â€Å"no† to the media. As the NACDL has forged and is now binding in the courts of America, all parties involved in the case – Judge, Prosecutors, Defendants, etc. – have to be asked. Everyone must be given the freedom to exercise his/he r right. Is it true that, because the eyes of the general public are watching a particular case, it thus precludes a fair trial?Does presence of cameras in the court demean and disrupt the proceedings? Are the participants in the hearing process – judges, attorneys, jurors, and witnesses – get affected negatively, and therefore adjust their behavior because they are conscious that they are being watched? No one knows for sure whether these are true or not. They may be in many cases, and again, maybe not. The important thing is to strike a balance in both sides and apply what is necessary to secure due process of law. Ptolemy I Soter was a Macedonian general under Alexander the Great who became ruler of Egypt *Aristotle was a Greek philosopher, a student of Plato and teacher of Alexander the Great. *Craterus was a Macedonian general under Alexander the Great and one of the Diadochi. *Parmenion was a Macedonian general in the service of Philip II of Macedon and Alexander the Great *Philotas was the eldest son of Parmenion, Alexanders most experienced and talented general. Plot .. The film is based on the biography of Alexander the Great, the King of Macedon, the first Macedonian Emperor who conquered Asia Minor, Persia and eventually Ancient India. It provides a glimpse into some of the key moments of Alexanders youth, and his invasion of the mighty Persian Empire, until his death. It also outlined his early life, including his difficult relationship with his father, Philip II of Macedonia, the conquering of the Greek city-states under the League of Corinth, and the conquest of the Persian Empire in 331 BC. It also details his new plans to reform his empire, and the attempts made to reach the end of the world. The storyline begins in 356 BC with Ptolemy I Soter, who narrates the story throughout the film. In lavish sets and images Stone shows his vision of Alexanders daily life in the court of his father, Philip, and portraying the strained relationship between his parents. Alexander grows up with his mother Olympias and his tutor Aristotle, where he finds interest in love, honour, music, exploration, poetry and military combat. Late on, his relationship with his father is destroyed when Philip marries Attalus niece, Eurydice. Thereafter Philip is assassinated and Alexander becomes king of Macedonia and the rest of Greece. After a brief mentioning of his punitive razing of Thebes and burning of Persepolis, Ptolemy gives an overview of Alexanders west Persian campaign, including his declaration to be the son of Zeus by the Oracle of Amun at Siwa Oasis, his great battle against the Persian Emperor Darius III in the Battle of Gaugamela, and his eight-year campaign at Hydaspes against Porus in modern day Pakistan), both of which are shown in the film. The plot also illustrates Alexanders private relationship with his childhood friend, Hephaistion, and later his wife Roxanna until his death. Before succumbing to an unknown illness or poison (it is never revealed which and both are suggested) Alexander distanced himself from his wife Roxanna despite her being pregnant, believing she has killed his childhood friend Hephaistion. The film accurately places Hephaistion in a far closer position than his first wife Roxanna. It is suggested in the film that Alexander died in part due to the loss of Hephaistion, which occurred less than three months earlier. Early in the film Hephaistion compares Alexander to Achilles, to which Alexander replies that if he is Achilles then Hephaistion is his Patroclus (Achilles cousin and supposed lover). Hephaistion mentions that Patroclus died first and then Alexander pledges that if he should die, he would follow him into the afterlife. A promise Ptolemy himself says Alexander apparently kept when he died shortly after Hephaistion. In the film after conquering Babylon Alexander admits that Hephaistion is the only person he loves. (no one can back up that Alexander was homosexual). During the film Hephaistion shows extensive jealousy when seeing Alexander with Roxanna and deep sadness when Alexander marries her, going so far as to attempt keeping her away from Alexander after the former murdered an old friend in India. The film also focuses intensively on the close and warped relationship Alexander shared with his mother Olympias. Summary .. Alexander was born in Macedonia in 356 BC. His father, King Philip II of Macedonia, hired the famous Greek philosopher Aristotle to tutor young Alexander. In the summer of 336 BC, Philip was murdered by one of his bodyguards. Alexander then became king. Many people in Macedonia plotted against the young king, but Alexander was shrewd. He quickly ordered the execution of all the conspirators. At the same time, some Greek cities ruled by Macedonia rebelled and others threatened to seek independence. Alexander crushed the rebellions and restored Macedonian rule. Next, in 334 BC, Alexander turned his attention toward the Persian Empire (now Iran) in southwest Asia. Alexander led Macedonian and Greek soldiers to attack Darius III, Persia’s king. Their armies met at Issus in Syria in 333 BC, and fought a fierce battle. Alexander won, and Darius fled. Alexander then led his soldiers south, into Egypt. Alexander seized power from the pharaoh, who ruled Egypt on behalf of the Persians. The grateful Egyptians saw Alexander as a person who freed them, and they crowned him pharaoh. At the mouth of the Nile River in northern Egypt, Alexander founded a new city. He named the city Alexandria, and it became a famous center of learning In 331 BC, Alexander led his troops back north into Persia. King Darius was eager for revenge. Alexander and Darius fought another great battle, this time at Gaugamela. Once again, Alexander won. The battle at Gaugamela ended centuries of Persian rule in Asia. Alexander then turned south and conquered other important Persian cities. At Persepolis, he burned down Darius’s palace to show he had conquered the Persian Empire. In 330 BC, Alexander went north to find Darius again. This time, Darius was killed by his own men as he fled. Alexander was a military genius and a great explorer. But he also had a grand ambition. He wanted to rule a world empire where people could live in peace with one another. From 330 to 327 BC, Alexander led his soldiers east, through Afghanistan and into Central Asia. As he travelled, he built more cities. He recruited soldiers, merchants, and scholars from many lands to settle there. In 326 BC, Alexander turned south, into India. Skilful staff represents the capital of any successful business and are, and will always be an important reason for its success. This report discusses some of the essential managerial and business skills acquired by companies. Firstly, leaderships importance and significant role is well highlighted in this report, for the belief that, in addition to any other business skills that you possess, possessing leadership attributes is crucial, because it will benefit your associates, managers, staff and even customers. People in General are influenced by leaders and sometimes, unconditionally follow their thoughts. Leaders are the primary target for marketers for they know, for the reasons mentioned above those leaders are more likely capable of increasing their market segmentation more than any other average person. Besides leadership, critical and creative thinking is an important attribute that every successful manager has to have. Technology is the moderns world tool of communication and not having enough knowledge about it will not end up with good results for the company. Based on my studying in Kent University and doing two degrees in Electronics and Communication Engineering and Financial accounting, there are important skills that I learned attending these courses which I also think will be of much significance for my career. New product development guarantees more success for the company because it relies on market analyses and innovative ideas to produce something new. In addition, financial management is a fundamental skill for any type of profession a person might chose. Any type of business has to be organized and sources of money received and spent have to be kept, otherwise the company will just be performing randomly. Leadership as a concept Leadership is the art of getting someone else to do something you want done because he wants to do it. Dwight D. Eisenhower Leadership is influencing peoples behaviors so that they become willingly prepared to work more towards achieving mutual objectives .consequently, an inspirational organizational culture will be created (Kotelnikov, 2001).The ability to inspire people to attain greater heights and dimensions of performance and consistent success is a skill acquired by Leaders in the new century. Passion and effective communicating are important attributes to make the leader inspirational, which will reflect on the organizations culture, making the employees more committed as we as turning the workplace into a thrilling environment (Heathfield, nd) Type of Leaders Leaders are the engine of a work, the motivation for employment, and the face of a company, thats why it is important t o choose the right leader into the right position. 3.1 Executive leaders (CEOs) shoulder the responsibility of clarifying the vision, mission and direction of the firm (Couler, 2010). CEOs participate in formal event; they also make speeches, but in fact have little impact on the daily business operation (Radcliffe, 2010). 3.2 Line leaders are the connections between low and top levels; especially in organizations with high hierarchy They have the power of presenting the executive leaders message to his/her staff. They are very influential in organizations, not only they can stop or alter any project, but also they can take a leadership position and promote change (Fletcher, 2010). 3.3 Network-leaders They are the invisible strength behind how the real firm operations. Whether they were Union Representatives or technical experts, These Leaders create a network of relationships that allow them to know much about the organization, and thus gain real knowledge about the organizations operations (Radcliffe, 2010). Creative and Inspirational Leadership In a survey that involved more than thousand and a half employees which asked those employees what attribute would they like to see most in their managers . More than half of the survey takers answered inspiration (DTI, nd). An inspired workforce is fundamental for any ambitious business that hopes to be ahead of its competitors. Inspiring people motivates them, makes them more objective oriented and enhance their creativity (Northouse, 2010). Our environment is shifting quickly and unpredictably. Creative employees are those who are capable of foreseeing future opportunities and are also able to change the workplace in which they work to a positive atmosphere (Northouse, 2010). Creative leaders are mostly needed in vital moments, where the organization cant find convenient solutions. They seek and find opportunities, bring in positive change and make huge efforts towards creating new products/services through new processes and innovative techniques (Kotelnikov, 2001). In addition creative thinkers have the capability to transform ambiguous problems to business opportunities. Besides their ability to analyse the environment, they also take part in building relationships, alliances and encouraging creativity (Fletcher, 2010). According to Jack Welch, the previous legendary CEO of General electric, a good leader is one who is capable of making people feel that they are real a contribution to the organization. Welch adds that working toward a shared and worthwhile goal can produce huge positive energy. In his Beginnings, Jack Welchs goal was to make General Electric the worlds most competitive multinational enterprise. He, therefore realised that only can revolutionary thoughts turn his dream to actual reality (Kotelnikov, 2001). The American corporate business model in the United States had not changed since 1980.Employees did their job, managers managed , and everybody knew his/her place. Those days were ruled by rules and forms and bureaucracy (Fletcher, 2010).. Welchs revolution meant changing the old ways of doing Business in the company and restructuring the company entirely. As a result of his inspirational influence and charismatic attributes, Today, General Electric stands as one of the worlds most admired and unique companies (Kotelnikov, 2001). Welchs successful techniques are applicable to small, growing and large companies. Those techniques mainly focus once again on articulating the companys vision, since creative managers inspire their employees with obvious visualizations of how things can be achieved better. Welch also recommends that the manager has to be simple. Simplifying things is a key factor of business (Kotelnikov, 2001). Simple messages travel faster, simpler designs reach the market faster and the elimination of clutter allows faster decision making., according to John Welch Clarifying and sampling things makes it easier for employees to know their position better, as a result they become more energized and focused on achieving objectives. Furthermore, Welch advices managers to always face reality, and act according to the actual situation. Ignoring reality means shifting away from long term objectives. Also, a company should seek any opportunity of change. Change is a big part of the reality in business, and readiness to change is a strength, even if it involves temporary confusion within the company, however in certain circumstances, it is a necessity. In addition Creative, Inspirational leaders are known as Risk Takers, they have a clear affinity to break the rule and take considerable risks, towards producing this change (DTI, nd). Critical Thinking Critical thinking is the procedure by which an individual comes arises with a new innovative idea (Powell, 2010). The process involves actively and proficiently gathering, analysing and evaluating information, based on an individuals observations, knowledge and past experiences. To be able to think creatively you have to be clear, precise, consistent and fair (The Critical Thinking Community, 2009) Critical thinking could involve integration of ideas which have not been combined before. Brainstorming is one significant form of creative thinking: it works by the unification of two or more peoples ideas in order to create a new innovative one (Powell, 2010). Besides the cooperative efforts taken to produce a new idea, however this process could sometimes be accidental (Brainstorming, 2006). This occurs when a certain circumstance arises and leads someone to start thinking about situations in a different manner, and sometimes leads to a valuable change(Powell, 2010). When a group of people share their knowledge and experiences, particularly if those people come from different cultures, new ideas start to appear in the horizon, because people from different cultural backgr ounds have experienced different situations and obstacles, hence, grouping the efforts in this manner will most likely produce this change (Brainstorming, 2006).Nevertheless, with continuous practice, (ongoing investigation, questioning and analysis) will develops an individuals general knowledge and understanding, resulting in a better perspective and forth seeing in sticky situations (Brainstorming, 2006). Critical thinking is the process in which of reasoned and disciplined thinking to a certain subject are implemented. In order to succeed in your studies future career you must be able to think critically about the things you have read, seen or heard. And in order to develop your critical thinking, there are certain levels (The Open University, 2009). Procession receiving information (i.e. in what you have read, heard, seen or done). Understanding Comprehend the key aspects, assumptions and evidence presented. Analyses Examining how those key aspects fit together and are related to each other. Comparison realizing the similarities and dissimilarities between the ideas you are developing. To Synthesise Bring together several sources of information to create an argument or an idea you are building. Also, it includes your ability to make logical associations between the various sources that help you outline and support your ideas. Evaluation Assessing the value of an idea in terms of how is it relevant its to your needs, the facts on which it is based and how it relates to other applicable ideas. Application Transforming the understanding you have gained from the evaluation level in order to use it in response to questions, assignments or projects. Justification Using critical thinking to develop your own arguments, draw conclusions and identify implications (The Open University, 2009). 6. Technology Skills Knowing only how to use basic technology skills such as internet browsing or e-mailing is not enough anymore. Possessing solid technological skills, on the other hand, will put you a step above your colleagues (Pavlina, 2006) In general, companies are extremely reliant on IT that they cant lay off the people who keep their data centre operations running, and neither they are willing let go of their developers, who will be familiar with the forthcoming technology. In general those are the most essential IT skills an employee, who is chasing a good career shall has: 1. Database Database expertise is an important skill that employers would love to see in their employees. Companies are looking for IT workers with experience, particularly in Microsoft SQL Server and the Oracle Developer Suite. According to a survey in 2008 which was conducted bye the Society for Information Management and was intended to know which skills do CIOs prefer for their job candidates. Expertise in databases was one of only four technological skills listed by CIOs, who besides, database also listed other attributes such as teamwork, problem solving and communication in hiring recent college graduates (Marcan, 2009). 2. Firms are for the most part interested in hiring staff with experience in unified communications and messaging systems. Efficient communication saves time, expenses and energy. Also it promotes a cooperative environment where people can communicate easily (Turner, 2005). 3. Project management SIMs 2008 CIO survey listed project management as one of the top 10 skills needed for mid-level employees. Companies require project planning leaders. Someone who has the ability to plan, schedule, and gets the results done.Project management skills are going to be more important over the next few years, according to Henry Eckstein, senior vice president of strategic technology at York Insurance Services Group (Marcan, 2009). 4. Networking Every company plans to increase its profits. And that could be done more conveniently whenever the company has more customers, partners and friends. Furthermore, the individuals own circle of people contributes to the overall companys network. Therefore, an employee with networking capabilities is another attribute job employers seek while recruiting (Turner, 2005). 5. Security Its true that there are many benefits for technology, but also it has some other disadvantages that can sometimes cause real obstacles in the firms track towards development. Hacking, Spamming and data system crashes can sometimes be very costly. Hence, the security of your data is worth money (Turner, 2005). Financial Management Through the past few years, and exactly starting from the electronics department at Kent University, the idea of business was gradually crossing my mind, since business field is very important now days, and because I always wanted to study this subject and improve my knowledge about it, the idea came to specialize in this major and learn about the management techniques and strategies to be able to combine my engineering degree in electronics and communications with the business skills I earned through this year, which contains valuable information on how to manage my life style, how to deal with others and be successful in the practical life, and last but not least to connect everything to business. I really believe that business management is a priority subject to be taught, and in my case I can combine my business MSc degree with my previous degree, and look for more opportunities like the consulting field for example, rather than looking into one direction only. It has been concluded that management accounting is a crucial when it comes to a company making vital and well-timed management decisions about their business (Abraham, 2008). However, it is obvious that different types of businesses will acquire different management accounting requirements. Financial management is important when considering the following areas: The sales process: which includes distribution, debtors and pricing. The purchasing process: includes records of stock levels and creditors. Records regarding employees. A fixed asset registers (Collier, 2009). Financial management is a very important major as I mentioned before, but personally I prefer to be specialised in the accounting finance sector and risks, because I think the accounting field is a sensitive one, also managing risks as well, because it helps ordinary people to understand the market, especially stock exchange market, by using the income and financial statements anyone with a bit knowledge about accounting and finance will be able to figure out the real prices per shares, dividends, return risks and more readings, which will lead us to think more realistic about facts and how to deal with them. Financing risks also very important, it prevents from falling into business traps and circumstances related to it, as well as crisis which can happen anytime and cause big manufactures to collapse, so being aware from risks is a benefit itself; James porter once said avoiding risks is more valuable than the income earned by that risk. There is no legal obligation for companies to draw up management accounts; however, many companies find that it makes running the business much simpler if they do prepare the accounts. In fact, many companies produce account reports monthly, quarterly and yearly to keep track of the financial transaction (Abraham, 2008). Management accounts are useful for analysing the previous and present performances, in order to visualise future trends. This includes looking at profit forecasts, income and cash flow statements in addition to sales (Abraham, 2008). The actual numbers collected from the analysis shall be continuously compared against numbers that have been previously predicted while designing the budget. The information collected for the management accounting is usually broken down so that the performance of different departments of the company can all be measured individually to make sure that all these departments capabilities are exploited (Collier, 2009). A convenient plan to start with is to design a fitting budget, which represents a roadmap for managers to constantly know where their businesses are actually standing. In order to design the budget the financial team has to design income and expenses tables, which will assist financial managers to notice where does the money come from and where does it go, so they can afterwards focus on those products that are generating products for the company, at the same time, getting rid of extra expenses (BBB, 2009). For businesses who are engaged in selling a selection of products, they are advised to produce a financial breakdown for each of them. This will allow you to make sure that very gainful products are not subsidising those that are failing to sell as well. Product development is the integrative process which includes the strategic organization, concept generation, product and marketing plan creation and estimation, and afterwards the commercialization of the new product (Ulrich, 2009).New product development is the energy that pumps the organizations innovation engine, and it is impossible for a firm to grow without developing new products (Ulrich, 2009). 8.1 LAUNCHING A NEW PRODUCT Once the product-line structure has been initiated and a new product is being developed, it is time for the company to consider how the product could be successfully launched to its target market (Reference for Business, 2010). This is the phase where an advertising or public relations agency can participate, especially for small businesses that lack the internal resources needed to handle such a job by them. However, when utilising an outside agency to launch a product, a company should firstly, have a well-defined product concept, also provide the agency with background information about its products and aims. Thirdly the firm has to have an official business plan. Lastly marketing and advertising plans should also be determined (Reference for Business, 2010). With annual sales that exceed  £4.5 billion, Kelloggs is the worlds leader of cereal products and convenience foods products, such as cookies, crackers and frozen waffles (The Times 100, 2010). In this particular industry, the growth in healthier lifestyles creates opportunities for Kelloggs to increase the number of products for this segment. 2. Price: The sum a company charges for its product is imperative in influencing the sales number, and giving the firm an idea about it. Big Brands like Kelloggs can charge a premium because of the quality of its product and the fame of its brand. 3. Place: Where customers can find the product is also an essential factor in determining sales. Your products have to be available where customers are most likely willing to buy them. This depends on the market analyses (Ulrich, 2009). 4. Promotion: Kelloggs uses above the line promotion like TV advertising as well as below the line promotion like on-pack promotions and sampling. Managers can take a decision on when to make key changes to core products by analysing its position within the product life-cycle. Life-cycle analysis accepts that products have a limited life, and analysts makes charts for products performance through several phases, starting with its launch stage through various phases of growth until it finally reaches development maturity and ultimately decline. An average products life cycle may last for few months, for instance food products. Nevertheless for super products it could last for years like the car industry (The Times 100, 2010). 9. Conclusion: This report is a reflection of the managerial skills obtained from studying at the University of Kent in both the Engineering and the Business departments. Doing both degrees supplied me with a flow of very essential skills which i think about as a future investment. Firstly, this report discussed the role of leadership and critical thinking in taking the companys success to another dimension. Those two attributes are crucially important. Leadership implies seeing and being able to analyze circumstances before it arises so that you are always ready to face them. Critical thinking is the mechanism that you use to produce innovative solutions in complex situations. These two attributes require expertise and cannot be acquired easily. Furthermore, this report discussed the importance of Technology in our modern world. There is no doubt about the fact that technology has already and will have a more significant role within which people will communicate with each other. Technology facilitates the way we live and communicate. Technology, when used efficiently will be a huge assistance for the company. The benefit of technology doesnt only stop at facilitating communication within the organization, but also it has a significant role for new product development. To produce a new product you need to be innovative and you also need the required technology to be available so the process of new product development is formed. And even if sometimes the new product is more expensive, but if it has good quality it can still be sold. Finally, Financial Management and budgeting skills are required by both small firms and giant Multi National Enterprises. Cash flow is the actual capital of the organization. It is important to realize how this capital is built accurately, thats why you have to keep track of all the money you spend in addition to the money you received. Appropriate Financial Management keeps the company away or at least lessen the risks it may face in the future. Looking at previous years trends can sometimes, but not always be useful. Circumstances change regularly, thus a successful manager is one who analyzes the whole environment strategically before taking and business decision. Successfully and efficiently managing is an integrative process. It is true that nobody can be excellent in every skill, being good in some of them, however, and always working on developing the other skills you are not very familiar with will improve your attributes as an individual, an employee or a manager. As a result, possessing business skills and developing them will end you up with a better career and a better life.

Uppsala Model, Transaction Cost Theory and Network Model According to Calof and Beamish (1995), internationalization is the method of adapting organizations operations (resources, strategy, structure,) to foreign environments. This process comprises of the amount and geographic distance of the foreign market that is entered; the different amount of activities that are carried out in the different countries and the intensity of integration of these activities. Firms go into internationalization as a result of their customers migrating and their competitors globalizing while some companies go into it as a symbol of success and progress (multinationalism idea). Due to the complexity of the processes involved in the internationalization, several theories have been designed by different scholars to enable the easy accomplishment of the international emerging markets. Amongst the theories and their different features that are to be discussed are; the Uppsala Model, Transaction Cost theory and the Network Model. Uppsala Model of Internationalization is the theory that is based on the learning and the evolutionary viewpoint. This theory is derived from the behavioral theory which is explained as the nature of the firm through behavioral actions of its customers and the country of its emergence (Cyert and March, 1992). This theorys strength is based on the knowledge on how to conduct a business in a foreign market on which without the knowledge, the intended company to internationalize would be rendered handicapped (Carlson, 1966). Firms using this theory have the tendency of entering a new market successfully through the geographic and psychic distance which means the summation of factors that is hindering the flowing of information from one market to another market; these include differences in language, education, business practices, culture, and industrial development (Johanson Vahlne, 1977, Johanson Associates, 1994). Just as it was mentioned in the 3rd lecture on the 8th of February, the socio-cultural environment/ culture and cultural differences have a big role to play when a company is entering a foreign market, this is because the ways of life of the people, organizations and government will be different from that of the domestic country of the entering firm. This means that the company has to plan on different strategies to use like using two or three languages pattern as the organizational language base and strategies to suit the countrys religion and other sensitive factors in order to be able to penetrate faster than it would have taken. Thus, the model expects that the internationalization process, once it has started, will tend to proceed regardless of whether strategic decisions in that direction are made or not. (Johanson Vahlne, 1990,) There are two types of knowledge that are involved in this theory; the general or objective knowledge which can be taught and the market-specific or the experimental knowledge which can only be learnt via personal experience and is difficult to transfer nor separated from its original source (tacit knowledge) Penrose, (1959). The experimental knowledge is very important as it cannot be easily acquired like the objective knowledge. An example of this can be the carrying out of marketing researches and reports. All the information on the threats and opportunities of the international market can best be gotten from the people working in that country just as it is explained in Johanson and Vahlne, 1990; That it is the experience that generates the business opportunities and constitute the driving force in the internationalization process. This is why this theory is seen to be a slow process because it involves the learning through experience from a firms own activities. It is always the lack of experiential knowledge in the new market that pushes the firm to use the internationalization characterized gradual process which is in stages and known to the Establishment Chain (Johanson and Wiedersheim-Paul, 1975). Critiques of Uppsala Model This model is too deterministic because its principles are predicted by the evolution of time. All its advances are based and controlled by the environment of which the firm exist or planning to internalize. The model does not take into account the interdependencies between different countriess markets of which a firm operates under. This model is mostly relevant to the physical product industries but usually very slow in entering distant markets in terms of psychic distance at an early stage and its frequently not valid for the service industries as services can be dynamic and more time compressed also requires initial commitments. Subsequently, there are many models and strategies that facilitate the faster and easier avenues to extend a business abroad, therefore, it is no longer necessary to build up knowledge using the in house method due to the present technology nature that stimulates the interactivity with customers. To conclude this theory, it is quite clear that this theory has the competitive advantage opportunities base to the amount of resources and researches that are carried out in the foreign country before entering. This model only focuses on the selected firm unlike other models that extends their researches to environmental explanatory variables rather than being static. The key features of Uppsala theory are: Firms first of all achieve their knowledge from the home market before moving to the distant markets. Organizations start their overseas operations from culturally/ geographically and religiously close nations and progress slowly to culturally and geographically further far-away countries. Organizations also launch their overseas operations by making use of the traditional exports and slowly but surely moving to the using of a more intensified and demanding operational modes like sales subsidiaries at the company and target country level. It is the objectives of the firm to produce abroad I all markets. Transaction Cost Theory is a cost that is incurred in creating an economic trading (which is the cost of taking part in a market, economies of scale and transportation cost). Normally, it is advantageous to have the external transaction costs more than the internal transaction costs, this will guarantee the companys growth but, if the internal transaction costs are more than the external transaction costs this will lead the company to a downscale by outsourcing. Transaction cost economics arises when multinational companies are more efficient than their markets and contracts in organizing interdependencies between their agents that are located in different countries. It is the theory of the role and size of a firm. If a company plans to utilize a firm-specific asset in a foreign market and this utilization has to be done in that market due to their localization factors for example, trade barriers, high transportation costs and some other specific factors, the company can best do this by obtaining the required license to invest abroad on their own facilities rather than using that of the foreign countrys market. This is because; the more intangible the firm-specific assets are, the stronger its tendency of being successful would be. Transaction Cost theory is closely related to the internalization theory. With the transaction cost theory, firms always strive to minimize their cost at all point during their operations and decision making. This is why firms would need to consider to either entering a foreign market with their total assets or collaborating with their external partners as externalization (Williamson, 1975). The failure of a foreign emerging market strongly depends on this decision (Williamson, 1979). The key features of the Transaction Cost Theory are: * The transaction cost approach focuses on costs and how these costs would affect a firms choice of market and their modes of entry into a new boundary market. * This theory views organizational structure as a single important arrangement for establishing and safeguarding transactions and reducing transaction costs between participants and across organizational boundaries. * The Transaction cost covers all the costs of searching for information about a foreign market, products, buyers and sellers; negotiation costs; and monitoring which is part of the enforcement costs. * Transaction costs and transactional difficulties increases when transactions are characterized by: Asset specificity; Uncertainty (internal and external); and Frequency of transaction. * The international market decision is made in a rational manner base on the analysis of the cost of transaction. * Organizations make decisions based on the evaluations and comparing of their cost of an entry mode that is related to their objectives. Critiques of Transaction Cost theory This theory can be wrong and also dangerous for corporate managers because of its assumptions on which it is based on. Firms are not mere alternatives for the structuring of efficient transactions when markets results disappoints; they hold a strong advantages for leading and controlling certain kinds of economic actions via a strategy that is extremely unusual from that of a market both national and international. Transaction Cost theory is bad for being put into practice because it fails to recognize the just mentioned difference (Masten, 1993). Conclusively, Firms should select the organizational forms and locations for which transaction costs are minimized. (Donaldson O`Toole, 2007).A firm should expand its operations until their cost of making an extra transaction within the firm is equal to the cost of making similar or more transaction in another place (foreign market). The firm should first of all continue to grow internally until external sources have a cost advantage before externalizing (Hollensen, 2007). Network Model: In the network model theory, the market is seen as a system of social and industrial relationships among customers, suppliers, competitors, families and friends within a given boundary and beyond. This is for the purpose of creating the opportunity and motivation for internationalization. Following the network perspectives, the strategic decisions that are usually taken by organizations strongly depends on the relationships between the various parties and individual firms also depends on the resources that are controlled by other national and international firms. The structure of the Network Model can be demonstrated below: Actors Activities Resources (Johanson and Mattsson, 1988) The key features of the Network Model are as follows: * This model is based on the theories of social exchange and focuses on firm behavior in the context of inter-organizational and interpersonal relationships. * The glue that bonds the relationships together between the actors is based on technical, economic, legal and above all personal ties. * The long-term relationships between business actors and the background in which the organization operates have the illustrative significance in the description of the internationalization of firms. * A firm does not act alone in relation to other actors in a market. * A conjecture in this model is that an organization is reliant on other firms resources surrounded by the same network; an example is the customer and supplier relationships. Critiques of the Network Model The start-up problem in this model prevents even-adoption of superior products; excess sluggishness can occur as no actor is be willing to put up with the over proportional threat of being the first adopter of a standard. In many cases, the existence of network effects could lead to a weak and inferior result in markets (pareto-inferior). Also, In the case of sponsored technologies, there is a possibility to internalize the otherwise more or less lost of network gains by strategic inter-temporal pricing. Private incentives to providing networks that can overcome the inertia problems can be made possible but still the assurance of social optimality would not be certain. Conclusively, the network relationships are significant opportunities for the acquirement of resources and knowledge that are necessary for foreign development of firms. Also, the relationships of firms in a domestic network can be used as bridges to other networks in other Countries. Consequently, the world tourism market has exploded, providing countries with a new source of jobs and income. In this paper I will examine the tourism industries in Greece, Italy, and Turkey in the context of both the European and worldwide tourism markets. Several questions will be addressed. How many tourists come to these countries annually? Where do these countries rank among the world's top tourist destinations? How much do tourists contribute to the local economy? From where do these countries draw most of their tourists What are the most popular cities to visit within these countries What are these countries doing to counter the effects of 11 September? In 2001, Europe attracted 58 percent of worldwide tourists, continuing its trend of being the world's most popular tourist destination (WTO 13). Since so many people visit Europe, the tourist sector plays a vital role in the economies of the respective countries. The tourism industry as a whole has struggled since the 11 September terrorist attacks, falling 0.6 percent worldwide and 0.7 percent in Europe in 2001 (WTO 11). However, the regions in which Greece, Italy, and Turkey lie (southern Europe and eastern Mediterranean Europe) have proved to be more resilient than other areas. Southern Europe actually experienced a modest 1.2 percent growth for the year (WTO 55). In the final four months of 2001, tourism in Europe dropped 6.6 percent, while the decline in southern Europe over this period was only 1.8 percent (WTO 11-12).? During his acceptance speech, Faulkner proclaimed that the award was made not to him as a man, but to his life’s work, which was created, â€Å"out of the materials of the human spirit something which did not exist before.† (PF ) He felt that the modern writer had lost connection to his spirit and that he must reconnect with the universal truths of the heart—â€Å"love and honor and pity and pride and compassion and sacrifice.† (PF ) Through his characters voice and exposure of their spirit, Faulkner solidified man’s immortality by â€Å"lifting his heart, by reminding him of the courage and honor and hope and pride and compassion and pity and sacrifice which have been the glory of his past.†(PF ) Although some critics have characterized his work as violet, dealing with immoral themes and the miseries and brutality of life; it can be argued that even his most sad and dep raved characters express positive virtues and personal strengths, even if by a negative example. The purpose of this paper is to discuss the portrayal and manifestation of the human spirit in a select few of William Faulkner’s literary characters, showing that they possess both human strength and flaws. So what is the human spirit and why is it significant? It is a somewhat indefinable concept. According to Faulkner the human spirit is the connection to the universal truths of the heart—â€Å"love and honor and pity and pride and compassion and sacrifice.† (PF) But more than that, he was concerned with the idea that man had become oblivious to the problems of the spirit; that he lost his awareness of the inner struggle of heart in conflict with itself.
